After a scare today, President Jimmy Carter is out of the cleveland hospital he checked in a few hours ago. The conditions that led to venerable figure having to be transported to the hospital are said to be of a stomach ailment. But he has exited out of the hospital.

Not a trial balloon, but looking like the final pronouncement : President Obama will announce this week that Elizabeth Warren, the Harvard Law School professor who first proposed the Consumer Financial Protection Bureau, will be named to a special position reporting to both him and to the Treasury Department and tasked with heading the effort to get the new federal agency standing, a knowledgeable Democrat told ABC News. What should have been an easy solution is now made into a complicated mess where no one is fully happy, and most importantly, the CFPB is still absent someone actually running the darn place.

The Break For 9/9/10: District Judge Rules DADT Unconstitutional

This will certainly generate some reaction : A federal judge in Southern California has declared the U.S. military's ban on openly gay service members unconstitutional. U.S. District Judge Virginia Phillips on Thursday granted a request for an injunction halting the government's "don't ask, don't tell" policy for gays in the military. And get this: Government lawyers argued Phillips lacked the authority to issue a nationwide injunction and the issue should be decided by Congress. The injunction was sought by the Log Cabin Republicans, a 19,000-member group that includes current and former military members. The Log Cabin Republicans are the largest group from the insane party to actually represent a common sense position, and that is the case here in their continued fight against DADT. They are still mental fools of course, but they requested this injunction and got it.

Federal authorities have decided to indict Roger Clemens on charges of making false statements to Congress about his use of performance-enhancing drugs, according to two people briefed on the matter. The indictment comes nearly two and half years after Clemens and his former trainer Brian McNamee testified under oath at a hearing before the House Committee on Oversight and Government Reform, directly contradicting each other about whether Clemens had used the banned substances. It truly is amazing how we have time to indict Clemens on steroids by can't find the millisecond to get our powerful government and corporate crooks.

Man, just when the good news was continuing to emerge on this issue , gay marriage will not be able to recommence in California this week . In fact, it will be on hold for at least another 2 months, as the Circuit Judges have ruled on the STAY to be extended until more appealing . The denial of rights or gay people continues, as the system takes place.

The Break/Sports Thread #1 For 8/12/10: Chipper Jones Out For The Rest Of The Season, But It May Lead To Another Season From Him

But it may lead to another season from him instead of a planned retirement at years end : It appears a torn left ACL will sideline Chipper Jones for the remainder of this season. But there's still a chance the Braves third baseman will at least attempt to recover from this knee injury and play beyond this year. Jones informed his agent, B.B. Abbott, that an MRI exam performed Thursday morning revealed that his left ACL is definitely damaged. The extent of the damage to the ligament is unknown. But the 38-year-old third baseman will likely need to undergo surgery to repair the torn ligament. "Something is definitely damaged," Abbott said. "I think he immediately needs to get it fixed." Jones has had a resurgence in the last couple of months after a start that indicated how this looked all to be his final year. Now the Braves will have to rely on Brooks Conrad to give them a little more contribution from third base, as Bryan McCann...

Terrible news to report, as former Alaskian Senator Ted Stevens has among those who has died in a private plan crash late last night in Dillingham, Alaska. The plan also included the former head of NASA in Sean O'Keefe. The news on Stevens is breaking locally on NBC 2 in Alaska from a family friend as the main source . Major condolences are extended towards his family, friends, and those who knew or where close with the longtime Senator.

The only main transfer story surrounding them this summer has been James Milner possibly leaving. They haven't been interested in buying any players to improve the squad for Villa to take the step needed for them to get to the levels of where Tottenham and Manchester City are trying or have arrived in the Top 4 level. Though the official word on why he quit isn't out yet, that most likely is the reason why this news on the days leading towards the start of the season has come as a major shock throughout the league. It could not have come at a worse time for the fans of the Villains, as this could be a make or break season for the club. And with O'Neill decision, it surely looks like the "breaking" will occur over the "making."

Obviously, the Anti-Defamation League, doing their own tasteless defamation last week, will have their mouths yell in anger at it all.

Photo from CBS And the news just keeps on coming, as Charlie Rangel has cut a deal to avoid an ethics probe : New York Congressman Charles Rangel has reportedly cut a deal to admit to ethical wrongdoing and avoid a potentially humiliating public trial. Harlem friends of Rangel tell CBS 2 they have been told that the details could be unveiled when the House Ethics Committee meets Thursday afternoon. It's the culmination of two years of scandal for the 20-term Democratic lawmaker. At issue is whether the former head of the House Ways and Means committee will admit to any serious ethical wrongdoing. Rangel is being charged with misusing his office for fundraising, failure to disclose income, belated payment of taxes and possible help with a tax shelter for a company whose chief executive was a major donor. And there you go.

It's official, Shirley Sherrod will sue Andrew Breitbart for the events of last week, as reported by the Associated Press. And with Breitbart virtually showing no remorse for his actions still, this is great to see Sherrod pursuing.

The Break For 7/28/10: Judge Blocks Portion Of SB 1070 (Updated)

The news is breaking in on the Judge blocking some parts of the controversial SB 1070 law, including this : That portion of the law is not going into effect. Violation of federal control of the law was the key determining point in this controversial issue, as the 11 Amendment looks to be the key determining factor. CNN's Jeff Tobin has indicated that this looks destined to go to SCOTUS next year. Update: Clearly not happy over Susan Bolton siding with the Obama Administration, Arizona's insane leader lashed out and said "The Fight is not over." The Album Sales Review For 7/28/10: Eminem Tops The Charts For A 5th Straight Week As Rick Ross Flops Once More

It looks like the Detroit legend will stay number one for another week incredibly, while disappointment and hard times are ahead for another flop CD from the former officer. Too funny : Eminem makes it five weeks in a row at No. 1 on the Billboard 200 as "Recovery" sells another 187,000 (down just 4%), according to Nielsen SoundScan. Rick Ross' "Teflon Don" arrives in the runner-up spot with 176,000. Ross' last three studio albums all debuted at No. 1, with his last set, 2009's "Deeper Than Rap," arriving with 158,000. The opener for "Teflon" is Ross' best sales week since 2008's "Trilla" arrived with 198,000. Less than even "Trilla?" With all of those guest appearances on that virtual compilation album, this has to be devastating to the Rick Ross camp and those that hyped him endlessly, figuring that all of this ridiculous momentum would lead to a bigger fan base buying his poser crap. The Yankees owner has suffered a heart attack at his Tampa, Florida home and rushed to the hospital. Steinbrenner, who turned 80 on July 4, had been reclusive in his appearances in the last few years, as his team has been slowly taken over by his songs Hal and Hank. More to come, as Steinbrenner is in serious condition at the moment according to reports. Updated: Now Tampa News ABC affiliate are reporting that George Steinbrenner has died.

Oh, just a devastating one folks : Nelson Mandela's 13-year-old great-granddaughter was killed in a car crash on the way home from a concert in Soweto on the eve of the World Cup, his office said Friday. The Nelson Mandela Foundation said Zenani Mandela died in a one-car accident and no one else was injured. No other details on the crash were immediately available. Zenani, who celebrated her 13th birthday June 9, was one of the anti-apartheid icon's nine great-grandchildren. "The family has asked for privacy as they mourn this tragedy," the foundation said in a statement. Man, what a blow, what a blow, what a blow. The Whole Delivery, always sending blessings to the Mandela family, send one for sure now. Oh what horrible news.
